The Transgender Persons (Protection of Rights) Act, 2019 is India's principal legislation protecting the rights of transgender persons, covering non-discrimination, welfare and access to education, healthcare and employment.

Basic Details

Enacted: 2019; brought into force 10 January 2020.
Background: Enacted in the aftermath of the Supreme Court's judgment in NALSA v. Union of India (2014), which recognised transgender persons as a "third gender" and affirmed a constitutional right to self-perceived gender identity under Article 21.
Purpose: To prevent discrimination against transgender persons and provide for their welfare, protection of rights, and access to education, healthcare and employment.

Key Provisions (2019 Act, as Originally Enacted)

Non-Discrimination: Prohibited discrimination against transgender persons in employment, education, healthcare, and access to public services and facilities.
Certificate of Identity: Provided for a certificate of identity as transgender, issued by the District Magistrate, based on self-perceived gender identity.
National Council: Provided for a National Council for Transgender Persons to advise the Central Government on policy, monitor implementation, and redress grievances.
Penal Provisions: Criminalised specified offences against transgender persons, with prescribed penalties.

The 2026 Amendment

Enacted: The Transgender Persons (Protection of Rights) Amendment Act, 2026 received Presidential assent on 31 March 2026.
Removes Self-Declaration: Deletes Section 4(2) of the 2019 Act, which had guaranteed a transgender person's right to self-perceived gender identity.
Narrows Coverage: Removes categories such as trans-men and trans-women, irrespective of surgery or therapy status, and "genderqueer" persons from the law's coverage.
New Basis for Recognition: Shifts legal gender recognition from self-declaration toward institutionally verified criteria, such as medical certification.

Significance

Foundational Law: One of the primary legislative instruments codifying transgender rights in India, alongside the constitutional foundation laid by the NALSA judgment.
Under Constitutional Challenge: The 2026 Amendment's removal of self-perceived identity has been challenged as a rollback of rights read into Article 21, in a pending writ petition filed by transgender rights activist Laxmi Narayan Tripathi on 24 April 2026.
