Introduction

On 27 May 2026, the Supreme Court upheld the Bihar Special Intensive Revision (SIR). It held that an electoral roll must be accurate, inclusive and legally valid for free and fair elections. The constitutional task is two-sided: no eligible citizen should be excluded, and no ineligible person should remain enrolled.

Scope and Process of Special Intensive Revision

SIR is a Commission-directed, field-based revision of electoral rolls. It verifies existing entries more deeply than an ordinary summary revision and enables eligible new voters to seek inclusion.

Meaning of SIR: A special and intensive verification exercise that checks eligibility, ordinary residence and other statutory conditions for electoral enrolment.
Intensive revision: Under Rule 25 of the Registration of Electors Rules, 1960, the electoral roll is prepared afresh and the procedure for first preparation applies.
Summary revision: The existing roll is updated through a draft roll and a list of amendments, using readily available information.
Enumeration phase: Booth Level Officers (BLOs) visit households, distribute and collect Enumeration Forms, and assist voters in online or offline submission.
Draft roll: The Electoral Registration Officer (ERO) publishes the provisional roll for public scrutiny.
Claims and objections: Electors and political parties may seek inclusion, correction or deletion through the statutory process.
Notice, hearing and final roll: Before an adverse decision, the ERO or AERO must issue notice, hear the elector and pass a reasoned order.

House-to-house verification distinguishes SIR from routine updating

Field visits help identify changes that may not appear in routine records. These include death, permanent shifting, duplicate registration and newly eligible voters. The BLO also becomes a direct contact point for the voter.

Appeal channels protect voters against incorrect exclusion

An elector aggrieved by an ERO decision can appeal to the District Magistrate under Section 24(a) of the Representation of the People Act, 1950, read with Rule 27 of the Registration of Electors Rules, 1960. A second appeal lies with the Chief Electoral Officer under Section 24(b). These remedies make the revision process subject to administrative review.

Constitutional and Legal Provisions

The legal framework balances universal adult suffrage with the duty to maintain a valid electoral roll.

Article 324: Vests superintendence, direction and control of electoral rolls and elections in the Election Commission of India.
Article 325: Requires one general electoral roll for every territorial constituency. Exclusion only on religion, race, caste or sex is prohibited.
Article 326: Provides adult suffrage. An elector must be an Indian citizen, at least 18 years old on the qualifying date, ordinarily resident in the constituency and not otherwise disqualified by law.
Article 327: Empowers Parliament to make laws on elections, including preparation of electoral rolls.
RPA, 1950, Section 16: Disqualifies a person who is not a citizen, is declared of unsound mind by a competent court, or is disqualified under election-related law.

Evolution of Electoral Roll Revision in India

India’s electoral roll system developed from a limited colonial franchise into the legal base of universal adult suffrage. The following events show why SIR has become a major constitutional issue.

1935 — Government of India Act: Created a formal statutory framework for preparing and revising electoral rolls, but under a limited franchise.
1950 — Constitution and Representation of the People Act, 1950: Established one general electoral roll, universal adult suffrage and a statutory system for preparing and revising rolls.
1960 — Registration of Electors Rules: Laid down the detailed procedure for preparing, revising and correcting electoral rolls.
1951 to 2004 — Earlier intensive revisions: The Election Commission states that intensive revisions were conducted eight times during this period.
2003 — Last intensive revision in Bihar: Bihar’s later rolls were mainly carried forward through summary revisions for more than two decades.

24 June 2025 — Bihar SIR ordered under Article 324 and Section 21(3)

The Election Commission ordered SIR for every Assembly constituency in Bihar. It cited the long gap since the 2003 intensive revision, migration, urbanisation, possible multiple entries and the need to verify eligibility. The exercise became the first major test of the present SIR framework.

27 May 2026 — ADR v. Election Commission of India upheld Bihar SIR

The Supreme Court held that SIR is traceable to Article 324 and Section 21(3) of the Representation of the People Act, 1950. It found that SIR had a legitimate aim of restoring electoral-roll accuracy and was supported by notice, hearing and appeal safeguards. The Court also clarified that the ECI may conduct a limited citizenship enquiry for electoral eligibility, but it cannot conclusively decide citizenship.

14 May 2026 — Phase III extended SIR to 16 States and 3 Union Territories

The Election Commission announced a phased SIR covering 16 States and 3 Union Territories. More than 3.94 lakh BLOs were to visit 36.73 crore electors in this phase. The wider rollout makes inclusive and transparent verification a national governance issue.

Need for Special Intensive Revision

SIR is needed when routine updates no longer give a dependable picture of the actual electorate. It should improve roll quality without weakening the right of every eligible citizen to vote.

Remove duplicate registration: Frequent migration can leave a voter enrolled at both the old and new residence. SIR checks ordinary residence through field verification.
Delete outdated entries: Deaths and permanent address changes may not reach electoral authorities promptly. Such entries weaken the accuracy of the roll.
Include newly eligible citizens: Young citizens who attain 18 years, migrants and persons left out of earlier rolls need a clear route for enrolment.
Correct personal details: Wrong names, age, address, photographs or polling-station mapping can prevent a genuine voter from voting.
Verify statutory eligibility: Citizenship, age, ordinary residence and absence of legal disqualification are conditions for enrolment under Article 326 and the RPA, 1950.
Protect electoral integrity: A credible roll reduces impersonation, bogus voting and disputes over the electorate before an election.
Build public trust: Voters, BLOs, political parties and BLAs can examine the draft roll and file claims or objections. This shared scrutiny improves legitimacy.

An accurate roll is the first safeguard for free and fair elections

Elections can be fair only when the electorate is correctly identified. The Supreme Court described the electoral roll as the legal record of the political community. SIR therefore concerns both electoral administration and equal political participation.

Issues and Challenges

The constitutional validity of SIR does not remove the risks in its design or implementation. Each exercise must protect roll integrity and prevent wrongful disenfranchisement.

Document burden can exclude vulnerable electors

Poor households, migrants, women, elderly persons, Persons with Disabilities and marginalised groups may not hold or easily access all required documents. A legally valid process can still become exclusionary when assistance, alternatives and adequate time are absent. The test must be electoral eligibility, not the ability to produce difficult documents.

Large-scale field verification can produce human errors

SIR requires trained BLOs, reliable household visits, accurate data entry and close supervision. Missed houses, wrongly recorded deaths, migration errors or language barriers can lead to an incorrect draft roll. The scale of Phase III makes administrative capacity a critical issue.

Weak notice delivery can lead to wrongful deletion

An elector may not learn about a proposed deletion because of migration, poor connectivity or faulty contact details. Notice, a personal hearing, a speaking order and accessible appeals are essential safeguards. Deletion should never follow automatically from non-submission without a fair opportunity to respond.

Citizenship enquiry must remain limited to electoral eligibility

The ECI must ensure that only citizens are enrolled, but it is not the authority that finally decides citizenship status. In ADR v. Election Commission of India, the Supreme Court held that the ECI may make a limited enquiry for electoral purposes. If citizenship is in doubt, the competent authority under the Citizenship Act must decide it according to law.

Data privacy and security concerns

SIR involves household details, identity records and digital submissions. The Election Commission should follow data minimisation, secure storage and controlled access practices. Public roll transparency should not expose more personal data than electoral law requires.

Political mistrust can reduce cooperation

A revision exercise near an election can trigger allegations of bias or selective exclusion. Open schedules, equal access for BLAs, published reasons for deletions and transparent disposal of claims are necessary to maintain trust across political parties.

Recommendations and Reforms

Reforms should make SIR both rigorous and inclusive. The aim is not merely a shorter roll, but a correct roll that protects every eligible voter.

Apply ADR v. Election Commission of India safeguards in every SIR

The Supreme Court’s 2026 ruling requires the ECI to preserve due process in substance. Existing entries carry a presumption of validity, though it is rebuttable. Any proposed exclusion should rest on material, notice, hearing and a reasoned order.

Refer citizenship disputes to the competent authority

The Court directed that cases where citizenship is not established for electoral purposes must go to the competent authority under the Citizenship Act. The ECI’s decision can affect enrolment, but it cannot become a final declaration on citizenship. This separation protects electoral integrity and institutional limits.

Use a risk-based verification model

The ECI should use data matching to flag likely duplicate, deceased or shifted entries, while retaining door-to-door verification where it is genuinely needed. This can reduce the burden on ordinary voters and help officers focus on high-risk records. Automated flags must be reviewed by a human officer before any adverse action.

Provide assisted enrolment for vulnerable groups

BLOs should conduct repeat visits and targeted camps for elderly persons, Persons with Disabilities, homeless citizens, migrant workers, women with weak documentation and remote habitations. Forms should be available in local languages and through both paper and digital routes. No voter should lose enrolment only because they cannot use an online system.

Make draft-roll scrutiny easier and time-bound

The ECI should publish draft rolls in searchable and accessible formats. It should clearly state the reason for every proposed adverse action, provide helpline support and track claims, objections and appeals. Decisions should be issued within stated timelines before publication of the final roll.

Ensure transparency through political-party participation

Recognised parties should appoint BLAs at every polling booth and receive timely access to draft rolls and revision schedules. Regular BLO-BLA meetings, recorded minutes and public disclosure of aggregate disposal data can reduce suspicion and improve correction of errors.

Strengthen continuous roll maintenance between SIR exercises

Annual summary revisions and continuous updating should use death registration, address changes and migration information, subject to law and privacy safeguards. Better routine maintenance will reduce the need for disruptive, large-scale revisions. SIR should remain an exceptional corrective measure when a deeper reset is needed.
