Concept

Fast-Track Courts (FTCs) are special trial courts set up within the existing judicial hierarchy, mostly at the Sessions Court level, to expedite the disposal of long-pending cases, heinous crimes, and offences against vulnerable groups, without creating a parallel judicial tier. A specific category, Fast Track Special Courts (FTSCs), was created in 2019 exclusively for rape and Protection of Children from Sexual Offences (POCSO) Act cases, and functions as a distinct centrally sponsored scheme.

Constitutional and Legal Basis

Article 21: The Supreme Court, in Hussainara Khatoon v. State of Bihar (1979), read the right to a speedy trial into the right to life and personal liberty, forming the constitutional basis for fast-tracking justice.
Article 14: In State of West Bengal v. Anwar Ali Sarkar (1952), the Supreme Court held that speed alone cannot justify diverting a case to a special court; any such classification must rest on a rational, objective basis such as the nature of the offence.

Dimensions

Judicial: FTCs and FTSCs dispose of cases faster than regular courts, but rising judicial vacancies limit how many benches can actually function at full capacity.

The 2012 Nirbhaya gang-rape case was the direct trigger for the Criminal Law (Amendment) Act, 2013 and eventually the dedicated FTSC scheme for sexual offences.
The Andhra Pradesh High Court set up a special court in 2010 for the Satyam Computer Services scam, and the Supreme Court directed a dedicated special court for the 2G spectrum case in 2011 — both examples of case-specific special courts distinct from the FTC/FTSC scheme.

Way Forward

Fill Judicial Vacancies: Sanctioned FTC/FTSC posts must be filled promptly, since disposal rates are directly tied to how many courts actually function.
Strengthen Non-Judicial Support: Invest in forensic labs, witness protection infrastructure and dedicated prosecutors, since the Ministry of Law and Justice itself attributes delays chiefly to these factors, not to court design.
Rational Classification: Any new fast-track court, such as one for paper-leak cases, must be based on an objective classification consistent with Article 14, not created ad hoc under public pressure.
Realistic Timelines: Since the Supreme Court, in P. Ramachandra Rao v. State of Karnataka (2002), held that fixed outer limits for trials are not judicially permissible, reform must focus on administrative capacity rather than statutory deadlines alone.
