Overview

The Indus Waters Treaty is a 1960 India–Pakistan agreement that allocates the use of six rivers and creates institutions for information exchange, engineering cooperation and dispute settlement.

Core allocation: The Eastern Rivers—Ravi, Beas and Sutlej—are allocated to India, while the Western Rivers—Indus, Jhelum and Chenab—are allocated primarily to Pakistan, subject to specified Indian uses.

Essential institutional distinction
The adjudicative body is an ad hoc Court of Arbitration under the Treaty. The Permanent Court of Arbitration provides registry and secretariat services; it is inaccurate to describe the PCA institution itself as the deciding court.

Historical Evolution

The Treaty emerged from Partition-era disruption of an integrated irrigation network and nine years of negotiations assisted by the World Bank.

Partition problem: The 1947 boundary separated upstream headworks in India from canal systems serving areas that became Pakistan, turning an engineering network into a sovereign dispute.

Why parallel proceedings became contentious
Pakistan sought a Court of Arbitration in 2016 over Kishenganga and Ratle design issues, while India sought a Neutral Expert. The World Bank resumed both appointment processes in 2022 after a five-year pause, stating that the Treaty did not authorise it to choose precedence; India argues that simultaneous processes risk contradictory outcomes and violate the Treaty’s intended sequencing.

Why negotiated modernisation is preferable
A mutually accepted protocol can preserve clear allocations while correcting procedural ambiguity and climate-era gaps. It offers greater legitimacy and enforceability than competing unilateral interpretations.
